Broadband Hosting Acceptable Use Policy and Service Guidelines
Broadband Hosting provides web hosting to many clients, and we have a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.
Content:
All services provided by Broadband Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute, and invasion of privacy. The subscriber agrees to indemnify and hold harmless Broadband Hosting from any claims resulting from the use of the service which damages the subscriber or any other party.
All pornographic content and sex-related merchandise is prohibited on all Broadband Hosting servers. This includes sites that may infer sexual content or links to adult content elsewhere. Broadband Hosting will be the sole arbiter in determining violations of this provision.
Also prohibited are sites that promote any illegal activity or present content that may be damaging to Broadband Hosting servers or any other server on the Internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Warez sites
Broadband Hosting will be the sole arbiter as to what constitutes a violation of this provision.
Unsolicited Bulk Email (Spam):
Spamming, or the sending of unsolicited email, from a Broadband Hosting server or using an email address or domain that is maintained on an Broadband Hosting machine is STRICTLY prohibited. Broadband Hosting will be the sole arbiter as to what constitutes a violation of this provision.
Misuse of System Resources:
Any attempt to undermine or cause harm to a server, or customer, of Broadband Hosting is strictly prohibited. This includes, but is not limited to: using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or autoresponders other than for the customer's own account; resale of disk space without an appropriate reseller agreement; use of servers for backup of files unrelated to the web site of the account; or resale or remote access to CGI scripts installed on our servers. Operation of IRC servers or IRC bots on our servers will result in an immediate suspension or termination of service.
Due to their use of flat files instead of databases, Broadband Hosting does not allow the use of UBB or YABB bulletin boards. Use of these boards for large or very active forums, results in system performance degradation, and cannot be allowed in our shared server environment. Broadband Hosting suggests using VBulletin or phpBB as a more efficient, database-driven alternative to these bulletin boards.
Why does Broadband Hosting have this policy?
Server Speed and Fairness to others. A Virtual Server is shared. As such, there are many accounts per machine. In all fairness, Broadband Hosting cannot allow one or two clients to use all of the System resources on a shared machine and have all other clients on the machine suffer because of it. Excessive CPU usage by one or more clients causes extreme slowness in all areas: FTP, Telnet, Web Sites and more. If the CPU usage gets too far out of hand, all sites hosted on the machine will return Errors and not be accessible in any way.
What happens if I violate this policy ?
All accounts that are found to using excessive amounts of system resources will receive an email warning from Broadband Hosting. This warning will inform you that there is too much CGI running and it will provide options for reducing the usage or upgrading your server. If you do not reduce the usage within 24 hours of the email being sent, your CGI scripts will be disabled.
Cancellation:
Cancellation can be made via email to our . Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service all hosting fees will be refunded. This does not include fees for domain registration or set-up fees.
Suspension:
Activity which results in a suspension or deactivation of an account will result in a forfeiture of all fees paid, including annual contracts. Complaints made by others regarding abuses of an account will be grounds for suspension.
Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
All sub-networks, distributive hosting sites, and dedicated servers of Broadband Hosting must adhere to the above policies. Please direct any reports of violations of the above policies to our
File Back-Up:
Client is solely responsible for independent backup of data stored on Broadband Hostings servers. Broadband Hosting has the right to erase all files upon termination of service.
Client Responsibility:
The client agrees to take all steps necessary and prudent to protect their login ID and password. The client is responsible for all activity originating from their account unless proven to be a victim of outside hacking or address forgery. It is the client's responsibility to maintain a local or backup copy of their website's content.
Broadband Hosting shall not be responsible for any claimed damages which may arise from the servers going offline or being unavailable for any reason. Broadband Hosting is not liable for any damages, judgements or expenses resulting from any final determination that the content in its customer's accounts infringes any trademark, trade secret, copyright, patent or third party intellectual property rights.
